Terms of Service

Welcome to the Monolithic Dome Institute website (“Website,” “Site”), created by Monolithic Dome Institute LLC (“MDI,” “Institute,” “We,” “Us”) and published at monolithicdome.com. This Terms of Service (“Terms”), which incorporates our Privacy Policy, is a contract between Us and you that articulates your rights and our rights relating to the Site.

Don’t stop reading, please. These rules are important! By using the Site, you are agreeing to be bound by these Terms. You should know what they say, especially because if you do not agree to these Terms, you should not use the Site.

What is monolithicdome.com?

The monolithicdome.com Website is an industry website devoted to the advocacy of the Monolithic Dome. We publish content such as news, white papers, feature stories, project profiles, and promotional materials related to the Monolithic Dome industry.

MDI grants you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the Website in the manner described herein.

This means that you can read, listen to, watch, and intellectually consume everything on the Site. In exchange, we ask that you use the Site in the manner and spirit for which it was created and that you adhere to the policies that govern the Site’s use.

So in case it is unclear, you are NOT permitted to interrupt the serving of our Site, introduce malicious code to our system, assist anyone in misusing the Site in any way, or use the Site to violate the law or the safety or dignity of another person in any way. It takes a lot of work to make this site run. Be cool.

Content

Linking to monolithicdome.com with attribution is allowed and encouraged. Link to the Website. Do not hot-link directly to images. Content may be used for personal and non-commercial use. Permission must be obtained for using any content for commercial use.

This concept is confusing to a few people (spammers) so we will give an example. If you wish to use some of our material in a school classroom setting for teaching students about the Monolithic Dome, that is an excellent non-commercial use and we encourage it. If you wish to copy pages from monolithicdome.com and republish them on a site surrounded by ads, that is commercial use and not allowed without permission.

We reserve all copyrights for our content. We may, at our discretion, request and require removal of any Institute content for any reason from any form of publication.

Accuracy

We strive for accuracy but cannot guarantee it. The Institute takes no responsibility, nor assumes any liability, for mistakes and inaccuracies that may exist on the Website. The Website is a living document and changes constantly. There will be errors and omissions. These are unintentional and will be corrected if brought to our attention. Please contact us if you find something you believe should be updated, corrected, or added. Submitted corrections are subject to User Content terms listed below.

Structural dimensions

Dimensions published for structures on this Website are typically rounded to whole numbers. If a secondary measure is given—such as feet and meters—the second dimension is also rounded. Like our content, we strive for accuracy, but we cannot guarantee accurate dimensions. We publish what we can, but mistakes, ommissions, inaccurate submissions, and other errors may exist. We assume no responsibility nor liability for inaccurate dimensions. Please contact us with corrections if you find an error.

Calculators

MDI hosts various calculators to aid in sizing, designing, pricing, and building domes. Be aware that just because the calculator can draw a structure, it does NOT mean the structure can be built. Always consult with qualified professionals before proceeding with a project.

We’ve done everything we can to ensure the calculations are accurate, and the overlays are to scale. However, due to the complex nature of web development, we cannot guarantee the results are now or always will be correct. All calculators and other software are provided “as is,” without any kind of expressed or implied warranty. We are not liable for any claim or liability arising from or in connection with this software.

No implied claims

No expressed or implied claim is made for any involvement in projects discussed, mentioned, or featured on the Website. MDI is an educational organization and is not a contractor or design firm. All projects listed belong to the customers, contractors, design professionals, and subcontractors who built them. MDI may reference—at our discretion—the participants of a project, however, the absence of these references does not imply any other connection.

No implied endorsement

Any company, individual, or project discussed, featured, or listed on this Website are for informational purposes only. The Institute does not endorse, approve, guarantee, or certify any company or individual listed on the Website. MDI cannot endorse a company or individual regarding their expertise, fitness, abilities, or relevance to the Monolithic Dome industry. You are responsible to contact references and determine for yourself the fitness of an organization or person when pursuing a project with them.

Non Monolithic Domes

Not every project discussed or listed on this Website is about a Monolithic Dome—a structure built using the method developed and patented by David, Barry, and Randy South. There are thin-shell concrete structures, geodesic domes, and various curved architecture that we will list and feature. Inclusion of non-monolithic structures in this Website does not imply a connection between the structure, the project participants, and the Monolithic Dome industry.

User Content

Anything submitted by users to MDI including letters, comments, images, videos, text, or other works, are considered User Content. By submitting content you assert that you have all the relevant copyright, trademark, and intellectual property rights to make that work available or have a well-reasoned belief that your republication of the work is a “fair use.”.

By submitting User Content, you grant us an unlimited license to use your content in any way we choose. This includes creative uses such as republishing the work on our ad-supported Website, forums, and elsewhere, and practical uses such as copying your content to make back ups of it, displaying it on the website, and distributing and modifying it as needed to make the Site work.

Because our servers are located remotely, and because User Content is retained indefinitely, you grant us these rights worldwide and irrevocably, and agree that we don’t owe you royalties for any use of your content based on these rights.

All other content is copyright Monolithic Dome Institute LLC.

MDI takes no responsibility for, nor assumes any liability, and expressly does not endorse or share the opinion of your User Content.

It should go without saying, but we’ll say it anyway: this Website contains links to other sites that are not owned or controlled by the MDI. Please be aware that We are not responsible for the privacy practices of such other sites. This Terms of Service applies only to this Website.

Indemnities and warranties

When you create content, you are solely responsible for it and the opinions that you express are your own. You will not hold us responsible [you indemnify us] for any User Content that violates any law or infringes the rights of any third party.

In the legal world, indemnify means you agree to hold MDI, its officers, directors, employees and agents, harmless from and defend them against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney’s fees and costs, arising out of or in any way arising out of or in any way connected with your access to or use of the Site, Services, and all Monolithic.org and User Content, your violation of these Terms of Service, your violation of any third party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; or (iv) or any claim that your User Content caused damage to a third party.

MDI WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, PUNITIVE OR EXEMPLARY DAMAGES, WHETHER IN TORT, CONTRACT, OR OTHER LEGAL THEORY, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE MONOLITHIC.ORG WEBSITE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA.

Governing law

Any claim or dispute between you and MDI arising out of or relating to these Terms, in whole or in part, shall be governed by the laws of the State of Texas, without respect to its conflict of laws provisions.

Changes

We may modify our Terms at any time.
